1. These general terms and conditions apply to every offer from the company and to every distance contract as well as order between the company and the consumer.

Before a distance contract is concluded, the terms and conditions shall be made available to the consumer. If this is not possible, it shall be indicated before the contract is concluded that the terms and conditions are available from the company and will be sent free of charge upon request.

If the distance contract is concluded electronically, the terms and conditions shall be provided electronically so that they can be stored in a durable manner. If this is not possible, it shall be indicated where the terms and conditions can be read electronically and that they will be sent free of charge upon request.

If there are special terms and conditions for products or services, these shall apply together with the general terms and conditions. In the event of conflicts, the consumer may invoke the most favorable provision.

If any provision of these terms and conditions is invalid, the contract and the remaining terms shall remain valid. The invalid provision shall be replaced by a similar provision that achieves the same purpose.

Situations not covered by these terms and conditions shall be assessed according to the spirit of the terms. Ambiguities in the interpretation of the terms shall also be assessed according to their spirit.

To register a user account, apply for credit, or purchase products via our website, you must be at least 18 years old. If you are under 18, parental consent is required according to the Swedish Parental Code. By purchasing products, taking out insurance, applying for credit, registering an account, or using our services on the website or in mobile apps, you accept our current general terms and conditions and confirm that the information you provide is correct.

We reserve the right to change these terms and conditions without prior notice. The version of the terms that applies at the time of your order shall govern your purchase.

2. The Offer

If an offer has a limited validity period or special conditions, this will be clearly stated in the offer. The offer is not binding, and the company reserves the right to modify or adjust it. The offer includes a detailed and accurate description of the products and services being offered so that the consumer can make an informed assessment. If images are used, they provide a true representation of the offered products or services. Obvious mistakes or errors in the offer are not binding on the company. All images, specifications, and data in the offer are indicative and cannot be used as a basis for compensation or termination of the contract. Images of products represent an accurate depiction of the offered products, but the company cannot guarantee that the colors shown exactly match the actual colors. Each offer contains sufficient information for the consumer to understand the rights and obligations associated with accepting the offer.

3. Payment

Card Payment: You can pay with Visa, Mastercard. Select card payment and follow the instructions.

Online Transfer – Klarna

Klarna: You can pay with Klarna by selecting this option at checkout and following the instructions. You need a Klarna account to complete the payment. If you do not have an account, you can easily register one at the time of purchase. The goods will be shipped immediately after payment, and no additional fees are charged.

4. The Agreement

If the consumer has accepted the offer electronically, the entrepreneur must immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by the entrepreneur, the consumer may terminate the agreement.

If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to protect the electronic transmission of data and ensure a secure web environment. If the consumer is able to pay electronically, the entrepreneur will apply appropriate security measures.

Within the limits of the law, the entrepreneur may verify whether the consumer can fulfill their payment obligations, as well as any facts and factors relevant for responsibly entering into a distance agreement. If, based on this verification, the entrepreneur has good reasons not to enter into the agreement, they have the right to refuse an order or application or to impose specific conditions for its execution, while providing the reasons for doing so.

5. Price

During the validity period specified in the offer, the prices of the products and/or services offered will not be increased, except for price changes due to adjustments in VAT rates.

6. Delivery and Execution

The company shall exercise the utmost care when receiving and fulfilling orders for products.

The company will fulfill accepted orders immediately, but no later than within 7 days, unless the consumer has agreed to a longer delivery period. Deliveries are made via courier service. The courier used will be specified at the time of order.

If the delivery is delayed, or if an order cannot be fulfilled, or can only be partially fulfilled, the consumer shall be informed within 7 days after the order was placed. In such cases, the consumer has the right to cancel the agreement without costs and to claim compensation.

In the event of cancellation in accordance with the preceding paragraph, the entrepreneur shall refund the amount paid by the consumer as soon as possible, but no later than within 14 days after cancellation.

The risk of damage and/or loss of the products rests with the entrepreneur until the moment of delivery to the consumer, or to an earlier designated and known representative of the entrepreneur, unless otherwise expressly agreed.

7. Complaints

Under Dutch consumer law, you have the right to submit a complaint regarding defects in a product within 2 years from the date of delivery, provided the defect existed at the time of purchase. The defect does not need to be immediately visible. To ensure your complaint is considered timely, please contact us within 2 months of discovering the defect.

To submit a complaint, please provide your order number, a detailed description of the issue, and photos of the defect. Contact our customer service via email or postal mail to the seller’s address. Our team will respond with a proposed solution based on the type of defect.

8. Right of withdrawal

As a consumer, you have the right to cancel your purchase within 14 days without giving any reason. The cooling-off period starts the day after you or a designated representative receives the product.

During this period, you must handle the product and its packaging with care. You may only unpack or use the product to the extent necessary to inspect it. If you exercise your right of withdrawal, return the product with all delivered accessories and, where reasonably possible, in its original condition and packaging, following the instructions provided at: davibikes.se/instruction. If it is not possible to return the bike in its original packaging, please use suitable alternative packaging.

To exercise your right of withdrawal, you must notify the seller within 14 days of receiving the product via email. Once notified, the product must be returned within 14 days.

9. Costs in case of withdrawal

If the consumer exercises their right of withdrawal, the seller shall bear the cost of returning the products. For this purpose, the seller arranges for the shipment to be collected by a courier, and the seller covers the cost.

If the consumer has paid any amount, the seller will refund this amount as soon as possible, but no later than 14 days after the withdrawal. This is subject to the condition that the product has already been received back by the seller, or that sufficient proof of full return can be provided.

10. Exclusion of the right of withdrawal

The right of withdrawal may only be excluded for products:

  • That cannot be returned due to their nature.
  • That are created by the seller according to the consumer’s specifications;
  • That are clearly personalized in nature;

11. Newsletter

  1. The newsletter service is provided by the seller.
  2. Subscription to the newsletter can be done by submitting a completed subscription form or by giving explicit consent during the order process. Once the newsletter subscription has been confirmed, the seller provides an electronic service, which involves sending emails to the customer with information about the seller’s products, promotions, and services. The customer may withdraw their consent to the newsletter at any time by clicking the unsubscribe link in the email or by sending a request to unsubscribe to the store’s email address.
  3. The content of the newsletter is protected by copyright. It is prohibited to copy, save, or distribute it without the seller’s consent.

12. DSA (Digital Services Act)

You must not publish content that constitutes illegal content under the Digital Services Act (DSA) or is otherwise unlawful.

We may review and remove content that is illegal. Users have the right to appeal content-related decisions.

When submitting a complaint, please provide your order number and full details of your issue. Our customer service team will do their best to resolve any problems with your order or product in accordance with our complaints policy.

Alternative Dispute Resolution

If we are unable to resolve your complaint through our internal complaints procedure, you may refer the matter to a free-to-use Alternative Dispute Resolution (ADR) organization approved for independent complaints review. For example, you can use RetailADR, which operates in line with EU consumer protection regulations.

Complaints can be submitted to RetailADR:

  • By post, using the RetailADR paper complaints form (downloadable from the same website).

Please note that submitting your complaint is your opportunity to provide any relevant evidence. Once submitted, RetailADR will assess your case and refer it to us. Questions regarding the process can be directed to the RetailADR Support Centr at https://support.cdrl.org.uk/. Final resolution may take up to 90 calendar days from the receipt of all information.
